The next instalment of the ongoing Capital Pointe construction saga will take place inside the courtroom.
The City of Regina filed documents on Wednesday asking the Court of Queen’s Bench to quash the decision made by the Saskatchewan Building and Accessibility Standards appeal board in August.
The decision gave more time and different options to Westgate Properties, the developers of the project.
The city is arguing the board’s conclusion is “unreasonable” and that the evidence and reasons do not support their conclusion.
The city is also arguing the board cannot authorize continued construction on the project or construction of permanent shoring at the site. This is because those actions would require building, development and street use approvals which are outside the authority of the board.
The three options given by the board are the entire project be completed by March 2020 with building beginning on April 1, permanent shoring is installed to prevent slumping or fill the hole by the fall.
Capital Pointe has drawn the ire from councillors and residents due to a large number of delays.
The matter is scheduled to be heard in court on Sept. 27.
