Despite his death this weekend, Terry Hincks will remain on the ballot the upcoming civic election.
Governed by the Local Government Election Act 2015, the election will proceed and only votes cast for the other candidates will count.
“Any votes that may be cast or may have been cast for Mr. Hincks will not count in the official tally,” explained Jim Nicol, chief returning officer.
“Whichever of the two in Ward 9’s council race receives the highest number of votes will be deemed elected.”
In Ward 9, the other candidates are Aidan Wotherspoon and Jason Mancinelli.
Hincks passed away Friday after a lengthy battle with cancer. He had been the incumbent in Ward 9 since 2003.
Staff at the polling stations in the ward will not be directing voters how to vote, but if asked Nicol is instructing them to confirm Hincks is a deceased candidate.
On election night on Oct. 26, votes cast for Hincks will be reported, but the number will be asterisked.
“What people do behind the voting screen and who they vote for is their business and their business alone, but I will reiterate that any votes cast in his name would not count,” Nicol said.
